I. Scope of application
This guide is applicable to foreigners applying for permanent residence in China.
II. Basis for approval Exitand Entry Administration Law of the People's Republic of China and Measures for the Administration of Examination and Approval of Foreigners' Permanent Residence in China
III. Acceptance agencies
The public security organs of the people's governments of cities divided into districts have direct jurisdiction over the municipal public security branches and county bureaus.
IV. Application conditions
Foreigners who have made outstanding contributions to China's economic and social development or meet other requirements for permanent residence in China may apply for permanent residence in China.
Foreigners applying for permanent residence in China should abide by Chinese laws, be in good health, have no criminal record, and meet one of the following conditions:
1. Direct investment in China, stable investment for three consecutive years and a good tax record;
2. Holding positions of deputy general manager, deputy factory director or above in China, or having associate professor, associate researcher or above and enjoying the same treatment, having worked in China for at least four consecutive years, having resided in China for not less than three years within four years, and having a good tax record;
3. It is of great importance or urgency to China. To make contributions and special needs of the country;
4. The spouse of the person referred to in subparagraphs 1, 2 and 3 of this paragraph and their unmarried children under the age of 18;
5. The spouse of a Chinese citizen or a foreigner who has obtained permanent residence status in China, whose marital relationship has lasted forat least five years, has resided in China continuously for at leastfive years, resided in China for not less than nine months per year,and has stable living security and residence;
6. Unmarried children under the age of 18 who go to their parents;
7. Those who have no immediate family members abroad and go to live with immediate family members in China, and have reached the age of 60, have resided in China continuously for at least five years, reside in China for not less than nine months per year, and have stable living security and residence.
V. Prohibitive requirements
Foreigners who do not meet the above conditions shall not be accepted to apply for permanent residence in China.
In addition, according to Article 24 of the Measures for the Administration of Examination and Approval of Permanent Residence of Foreigners in China, the National Immigration Administration may cancel the permanent residence of a foreigner with permanent residence status in China under any of the following circumstances, and at the same time confiscate the foreigner permanent residence ID card held by him or declare it invalid.
1. May cause harm to national security and interests;
2. being expelled by a people's court;
3. Obtaining permanent residence status in China by providing false materials or other illegal means;
4. having resided in China for less than three months a year or for less than one year within five years without approval.
VI. Application materials
Foreigners applying for permanent residence in China are required to submit the following materials in addition to the basic materials such as avalid foreign passport, health certificate, and proof of no criminal record abroad.
1. Investment personnel
(1) A copy of the business license of the enterprise legal person;
(2) enterprise annual report public certification;
(3) foreign investment project confirmation;
(4) Copy of capital verification report;
(5) Encouraged foreign investment enterprises shall also provide the confirmation offoreign investment projects encouraged by the state or a copy of the certificate issued by the provincial competent department that the enterprise is a foreign investment enterprise encouraged by the stateand a copy of the personal tax payment certificate;
2. Personnel in office
(1) Copy of employment certificate;
(2) Copy of foreigner's work permit in China;
(3) the copy of the unit registration certificate;
(4) enterprise annual report public certification;
(5) Copy of project certificate or confirmation;
(6) Copy of personal tax payment certificate;
3. Special personnel
(1) Copy of recommendation letter;
(2) Photo copies of relevant awards and achievement certificates.
4. Spouses of investment, employment or special personnel and their unmarried children under the age of 18
(1) Copy of marriage certificate, birth certificate or parent-child relationship certificate;
(2) Copy of foreigner permanent residence ID card for investment, employment and special personnel.
5. The reunion of husband and wife personnel
(1) Copy of marriage certificate;
(2) Copy of spouse's identity certificate;
(3) Copy of house lease or property right certificate;
(4) Photo copy of living security certificate.
6. parent-child reunion personnel
(1) Copy of birth certificate or parent-child relationship certificate;
(2) A copy of the identity certificate of the Chinese parents, or a copy ofthe valid passport and permanent residence ID card of the foreign parents;
(3) If both parents are divorced, a copy of the proof that the persontaken over has guardianship responsibility for the applicant should be presented;
7. Persons whose relatives take refuge
(1) the applicant has no immediate family members abroad photocopy;
(2) Copy of domestic kinship certificate;
(3) Copy of permanent household registration certificate and resident ID card of the Chinese citizen who is taken over; Or a copy of the valid passport and permanent residence ID card of the foreigner who is taken over;
(4) Copy of house lease or property right certificate;
(5) Photocopy of living security certificate.
一、适用范围
本指南适用于外国人申请在中国永久居留资格。
二、审批依据
《中华人民共和国出境入境管理法》、《外国人在中国永久居留审批管理办法》
三、受理机构
设区的市级人民政府公安机关，直辖市公安分、县局。
四、申请条件
对中国经济社会发展做出突出贡献或者符合其他在中国境内永久居留条件的外国人，可以申请在中国永久居留。
申请在中国永久居留的外国人应当遵守中国法律，身体健康，无犯罪记录，并符合下列条件之一：
1.在中国直接投资、连续三年投资情况稳定且纳税记录良好；
2.在中国担任副总经理、副厂长等职务以上或者具有副教授、副研究员等副高级职称以上以及享受同等待遇，已连续任职满四年、四年内在中国居留累计不少于三年且纳税记录良好的；
3.对中国有重大、突出贡献以及国家特别需要的；
4.本款第一项、第二项、第三项所指人员的配偶及其未满18周岁的未婚子女；
5.中国公民或者在中国获得永久居留资格的外国人的配偶，婚姻关系存续满五年、已在中国连续居留满五年、每年在中国居留不少于九个月且有稳定生活保障和住所的；
6.未满18周岁未婚子女投靠父母的；
7.在境外无直系亲属，投靠境内直系亲属，且年满60周岁、已在中国连续居留满五年、每年在中国居留不少于九个月并有稳定生活保障和住所的。
五、禁止性要求
对不符合前述条件的外国人，不予受理外国人在中国永久居留申请。
此外，根据《外国人在中国永久居留审批管理办法》第二十四条规定，具有中国永久居留资格的外国人有下列情形之一的，国家移民管理局可以取消其在中国永久居留资格，同时收缴其所持外国人永久居留身份证或者宣布作废。
1.可能对国家安全和利益造成危害的；
2.被人民法院判处驱逐出境的；
3.通过提供虚假材料等非法手段骗取在中国永久居留资格的；
4.未经批准每年在中国累计居留不满三个月或者五年内在中国累计居留不满一年的。
六、申请材料
申请在中国永久居留的外国人除需提交有效外国护照、健康证明书、国外无犯罪记录证明等基本材料外，还需提交以下材料。
1.投资人员
(1)企业法人营业执照副本复印件；
(2)企业年度报告公示证明；
(3)外商投资项目确认书；
(4)验资报告复印件；
(5)鼓励类外商投资企业还需提供国家鼓励发展的外商投资项目确认书或省级主管部门出具的该企业为国家鼓励发展的外商投资企业的证明复印件、个人完税证明复印件；
2.任职人员
(1)任职证明复印件；
(2)外国人来华工作许可复印件；
(3)单位登记证明复印件；
(4)企业年度报告公示证明；
(5)项目证明文件或确认书复印件；
(6)个人完税证明复印件；
3.特殊人员
(1)推荐函复印件；
(2)相关奖励、成果证明复印件。
4.投资、任职、特殊人员的配偶及其未满18周岁未婚子女
(1)婚姻证明、出生证明或亲子关系证明复印件；
(2)投资、任职、特殊人员的外国人永久居留身份证复印件。
5.夫妻团聚
人员
(1)婚姻证明复印件；
(2)配偶的身份证明复印件；
(3)房屋租赁或者产权证明复印件；
(4)生活保障证明复印件。
6.亲子团聚人员
(1)出生证明或亲子关系证明复印件；
(2)中国籍父母的身份证明材料复印件，或外国籍父母的有效护照及外国人永久居留身份证复印件；
(3)如父母双方已离异，应出具被投靠人对申请人具有监护责任关系的证明复印件；
7.亲属投靠人员
(1)申请人在国外无直系亲属证明复印件；
(2)国内亲属关系证明复印件；
(3)被投靠中国公民常住户籍证明及居民身份证复印件；或者被投靠外国人的有效护照及外国人永久居留身份证复印件；
(4)房屋租赁或者产权证明复印件；
(5)生活保障证明复印件。
